Cancellation of the Work Permit in Case of Employer’s Death (Domestic Workers)
In the event of the employer’s death, the domestic worker and the new employer wishing to issue a work permit for the worker must follow the below procedures:
- The new employer, whether one of the heirs or not, may visit one of the Labour Market Regulatory Authority (LMRA) branches to cancel the current work permit, in the presence of the domestic worker, in order to obtain their written consent.
- After completing the cancellation process, a new work permit can be applied for the domestic worker.
- If the domestic worker refuses to transfer to the new employer, they have the right to:
- Transfer to another employer
- Leave the Kingdom of Bahrain after the permit is canceled, if they do not wish to transfer.
Required documents:
- A copy of the death certificate (if applicable).
- Work permit issuance or cancellation application form for domestic workers.
- A copy of the applicant’s ID card.
Cancelling Work Permit in the event of the employer’s death (for an active registration or establishment)
LMRA directly removes the responsible person’s data from the expatriate workforce system upon receiving the death report from the MOH.
Retaining the same CR or Establishment Number
- If the deceased owns a CR, the heirs must update the ownership details at the MoIC, by visiting the ministry or using one of the available electronic channels. However, if the deceased owns an establishment registered in iGA, then the heirs should go to the customer service centre affiliated with IGA in Isa Town to request the modification of the responsible person for the establishment
- After making the necessary amendments at the MOIC or the IGA, as the responsible person for the commercial registration or the establishment, must visit to a customer service centre at one of the branches of the LMRA to amend the data of the responsible person in the EMS. This does not require the transfer of employees.
- Required documents:
- Registration form.
- Copy of the ID card of the responsible person.
- Copy of the CR (optional).
- in case of multiple partners:
- A signed letter from all partners.
- Copy of the Sharia Will.
- Copy of the power of attorney certified by the MoJ.
New CR/ Establishment Registration
- As an heir, you may apply to register a new commercial registration (CR) or a new establishment with the iGA, and you will be the responsible person.
- You can request the registration of a new establishment in Expatriate Management System by visiting one of the branches of the LMRA or by electronically registering the establishments on the website of the LMRA. Link to the new establishment registration service.
- After registering the establishment in the Expatriate Management System, services related to foreign workers can be provided, such as transferring the worker from the deceased's establishment to the new establishment
- Documents required to amend the data of the responsible person in the Expatriate Management System:
- A copy of the Registration Form.
- Shaira Will.
- A copy of the ID card of the responsible person
- A notarized power of attorney from all heirs authorizing a person to represent the deceased's employer.
Note: If the heirs do not communicate with the Authority within 6 months from the date of death, the Authority will cancel the work permits after sending a notification to the heirs by registered mail or email and text messages according to the data registered in the Expatriate Management System.
